Terms of Service for Nordlys Karaoke AS

These Terms of Service govern the provision and use of services offered by Nordlys Karaoke AS, Storgata 12, 0155 Oslo, Norway, email: [email protected], phone: +47 22 48 73 91. By booking, ordering, or otherwise using the services of Nordlys Karaoke AS, the customer agrees to be bound by these Terms of Service.

1. Introduction and acceptance of terms

These Terms of Service apply to all agreements, bookings, deliveries, rentals, and related services provided by Nordlys Karaoke AS. The terms apply to private customers, business customers, and any person acting on behalf of a customer.

By confirming a booking, paying an invoice, accepting a quotation, or using the services, the customer acknowledges that they have read, understood, and accepted these Terms of Service. If the customer does not accept these terms, the services may not be used.

2. Scope of services

Nordlys Karaoke AS provides karaoke-related services and equipment, including but not limited to:

• Karaokeutleie til private selskaper og bursdager
• Karaokeoppsett for firmafester og julebord
• Mobil karaoke med komplett lyd- og lysutstyr
• Karaokevert og teknisk support under arrangementet
• Temakvelder med tilpasset spilleliste og sceneløsning
• Utleie av skjermer, mikrofoner og høyttalersystemer

The exact scope of each assignment is determined by the quotation, booking confirmation, order form, or written agreement between the parties. Nordlys Karaoke AS may use subcontractors or third-party suppliers to fulfill parts of the service, while remaining responsible for the agreed delivery unless otherwise stated.

3. User obligations and responsibilities

The customer is responsible for ensuring that the venue is suitable for the agreed service and that all necessary permissions, access, and practical arrangements are in place before the event.

• Provide accurate and complete booking information, including date, time, venue address, contact person, and any special requirements.
• Ensure safe access to the venue, including parking, loading access, electricity, and sufficient space for equipment setup.
• Comply with all applicable venue rules, safety requirements, and public regulations.
• Supervise guests and ensure that equipment is not misused, damaged, or removed.
• Not tamper with technical equipment, wiring, software, playlists, or settings without authorization.
• Ensure that guests behave in a lawful and respectful manner, including compliance with noise restrictions, alcohol rules, and venue policies.

The customer is liable for damage to equipment, loss, theft, or excessive wear caused by the customer, guests, venue staff, or other persons under the customer’s control, except to the extent caused by Nordlys Karaoke AS.

4. Payment terms and conditions

Prices are stated in the quotation, booking confirmation, or applicable price list. Unless otherwise agreed in writing, all prices are in Norwegian kroner (NOK) and may be subject to applicable taxes, fees, and charges.

• Nordlys Karaoke AS may require a deposit, advance payment, or full prepayment before the event.
• Invoices are payable by the due date stated on the invoice.
• Late payments may incur default interest and reasonable collection costs in accordance with applicable law.
• Any additional services, extended hours, extra equipment, waiting time, or changes requested by the customer may be charged separately.
• If the customer fails to provide access or cancels at the venue after arrival, Nordlys Karaoke AS may charge the agreed fee in full or in part, depending on the circumstances and any incurred costs.

Nordlys Karaoke AS reserves the right to adjust prices for future bookings. Price changes do not affect confirmed bookings unless otherwise agreed.

5. Cancellation and refund policy

Cancellations must be made in writing by email to [email protected]. The cancellation is effective when received by Nordlys Karaoke AS.

• If the customer cancels well in advance, Nordlys Karaoke AS may refund amounts paid, less any non-refundable costs, administrative fees, or deposits expressly stated as non-refundable.
• If the customer cancels close to the event date, Nordlys Karaoke AS may charge a cancellation fee reflecting lost revenue, reserved resources, and incurred preparation costs.
• If cancellation occurs after equipment has been dispatched, setup has begun, or personnel have arrived at the venue, the customer may be charged the full or partial agreed amount.
• If Nordlys Karaoke AS must cancel due to circumstances within its control, any prepaid amount for undelivered services will normally be refunded, unless replacement services are agreed.

Refunds, where applicable, will be made using the same payment method used for the original transaction unless otherwise agreed.

6. Liability limitations

Nordlys Karaoke AS shall perform the services with reasonable skill and care. However, to the maximum extent permitted by applicable law, Nordlys Karaoke AS is not liable for indirect, incidental, special, or consequential losses, including loss of profit, loss of business, reputational damage, or loss of enjoyment.

Nordlys Karaoke AS is not responsible for interruptions or defects caused by:

• faults in venue power supply, internet connection, or infrastructure;
• actions or omissions by the customer, guests, venue operator, or third parties;
• incorrect information provided by the customer;
• force majeure events;
• equipment misuse, unauthorized modifications, or improper handling.

To the extent liability cannot be excluded, Nordlys Karaoke AS’s total liability for any claim arising out of or in connection with a service shall be limited to the amount paid by the customer for the specific service giving rise to the claim, unless mandatory law provides otherwise.

7. Intellectual property rights

All intellectual property rights in materials, branding, technical setups, playlists, arrangements, documentation, photographs, videos, and content created or supplied by Nordlys Karaoke AS remain the property of Nordlys Karaoke AS or its licensors, unless otherwise agreed in writing.

The customer is granted a limited, non-exclusive, non-transferable right to use the service and any included materials solely for the purpose of the booked event. The customer may not copy, distribute, resell, publish, record, or commercially exploit such materials without prior written consent from Nordlys Karaoke AS or the relevant rights holder.

The customer is responsible for obtaining any necessary permissions for public performance, recording, or publication of third-party music, images, or other content at the event, unless expressly agreed otherwise in writing.

8. Data protection and privacy

Nordlys Karaoke AS processes personal data in connection with bookings, customer communication, invoicing, service delivery, and legal compliance. Personal data may include names, contact details, billing information, event details, and technical communication records.

Nordlys Karaoke AS will process personal data in accordance with applicable data protection laws and only for legitimate purposes related to the provision of services, contract administration, customer support, accounting, and legal obligations.

• Personal data will be handled securely and with appropriate technical and organizational safeguards.
• Data may be shared with service providers, payment processors, accountants, or subcontractors when necessary to deliver the service or comply with legal requirements.
• The customer may have rights to access, rectify, erase, restrict, or object to certain processing of personal data, subject to applicable law.

9. Force majeure

Nordlys Karaoke AS shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to fire, flood, extreme weather, power outages, strikes, labor disputes, war, terrorism, governmental actions, transport disruptions, epidemic or pandemic-related restrictions, or failures of third-party services.

If a force majeure event occurs, Nordlys Karaoke AS may suspend performance, reschedule the service, or cancel the affected booking without liability for damages, subject to any mandatory legal rights of the customer.

10. Changes to terms

Nordlys Karaoke AS may update or amend these Terms of Service from time to time. The latest version will apply to new bookings and services from the date it is published or otherwise communicated.

For existing bookings, the terms in force at the time of booking shall apply unless a change is required by law or the parties agree otherwise in writing.

11. Applicable law and jurisdiction

These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Norway.

Any dispute arising from or related to these Terms of Service shall be submitted to the competent courts of Norway, with Oslo as the agreed venue to the extent permitted by mandatory law.

13. Severability clause

If any provision of these Terms of Service is found to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be interpreted and applied to the greatest extent possible to reflect the original intent. The remaining provisions shall remain in full force and effect.
